These Terms of Service (“Terms”) govern your access to and use of HolidayOS — the software platform available at holidayos.ai and app.holidayos.ai (the “Service”) — operated by Open Sky Labs Sdn Bhd, Suite 12-06, Binjai 8 Premium Soho, Lrg Binjai, Jalan Ampang, 50450 Kuala Lumpur, Malaysia (“Open Sky Labs”, “we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
HolidayOS is a business tool for travel agents and tour operators. It provides a client CRM, an itinerary builder, AI-assisted itinerary generation, pricing tools, proposal documents, and related features. The Service is intended for business use by travel professionals, not for consumers.
2. Accounts
You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account and for ensuring that your team members who access the Service comply with these Terms.
3. Plans, pricing, and payment
Paid plans and pay-per-use pricing are described on our pricing page. Prices are shown in USD unless a different billing currency is explicitly agreed at purchase. Introductory discounts apply for the period stated at purchase. Subscriptions renew automatically each billing period until cancelled; pay-per-use charges accrue when you generate an itinerary with AI. Applicable taxes may be added. Refunds and cancellation are handled per our Refund & Cancellation Policy.
4. Your content
You retain ownership of the content you bring to the Service — client records, inquiries, itineraries, images, and proposals (“Customer Content”). You grant us the rights needed to host, process, display, and transmit Customer Content solely to operate the Service. You are responsible for having a lawful basis to store your clients' personal data in the Service.
5. AI features
AI-generated itineraries, prices, and text are drafts produced by machine-learning models and may contain errors. You are responsible for reviewing all AI output before sending it to your clients. AI features may be metered and billed per use depending on your plan.
6. Acceptable use
You may not misuse the Service — including attempting to breach its security, reselling it without our agreement, uploading unlawful content, sending spam through it, or using it to infringe the rights of others.
7. Availability and changes
We work to keep the Service available and improve it continuously. We may add, change, or remove features. We will give reasonable notice of changes that materially reduce the Service's core functionality for paid plans.
8. Disclaimer and liability
The Service is provided “as is”. To the maximum extent permitted by law, Open Sky Labs disclaims implied warranties and our total liability arising out of the Service in any 12-month period is limited to the amounts you paid us for the Service in that period. We are not liable for indirect or consequential loss, or for the travel products and services you sell to your own clients.
9. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate accounts that materially breach these Terms. On termination we will make your Customer Content available for export for 30 days, after which it may be deleted.
10. Governing law
These Terms are governed by the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the courts of Kuala Lumpur.
